Introduction

Public Announcement is a publication, distributed as a website and newsletter, owned and operated by Public Announcement Global LLC, a New York State limited liability company (referred to herein as “PA”).

Our users’ privacy is important to us, and we have adopted this privacy policy, which applies to any and all information you submit to us in connection with your use, in order to ensure that you are fully informed about what information we collect from you, how we use it, our legal basis for doing so, and with whom we share it. We also describe here your rights with respect to the information that you provide us.

It is important to note that this Privacy Policy only applies to information that we collect. Therefore, if you use any links that lead to websites or other content owned or operated by third parties or if you access any other website, this Privacy Policy no longer applies. Further, if you use any features that are provided by third parties (which are described below), your use of those features is governed by those third parties’ agreements and policies. You should review the privacy policies adopted by those third parties to ensure that you know what information is being collected and for what it is being used.

Please read this Privacy Policy carefully prior to your registration for, access to, or use of our publication. If you do not agree to abide by this Privacy Policy, please do not sign up.

By accessing and joining our publication, you are accepting the practices described in this Privacy Policy and our Terms of Use. This Privacy Policy is governed by our Terms of Use, which include all disclaimers of warranties and limitation of liabilities.

We may change the terms of this Privacy Policy at any time. Whenever we make a material change, we will post or otherwise make available the revised policy. The effective date of the most recent version of this policy will appear at the bottom of this page.

What information does PA collect?

We collect information from you when you register on our site.

Since some of the services we provide through the site require you to register and create an account, we must gather and store certain information about you. When registering on our site, you may be asked to enter personally identifiable information, such as your name, e-mail address and payment information. You may, however, visit our site without registering.

We use third third-party vendors, identified below, to help with managing your account, hosting the website, delivery of the newsletter, and processing of your payment. We never see your full credit card number, which is handled through Stripe.

We will keep your information stored for as long as you have an account with us in order to provide you with our services. We may also retain your information for uses provided in this Privacy Policy and as necessary to protect our rights and comply with law. Anonymous information may be kept indefinitely.

Cookie Policy

We also collect information through the use of “cookies” or other similar technologies. “Cookies” are alphanumeric identifiers in the form of text files that are inserted and stored by your web browser on your hard drive or via mobile IDs. We (and, potentially, third party partners) may set and access cookies on your computer or mobile device to track and store preferential information about you, for purposes such as (i) recognizing you when you return to the site, (ii) personalizing the content that you see in order to ensure you enjoy your visit, (iii) collecting analytics data for our internal use, etc. Such information is used within our internal organization and is not shared with third party advertisers.

You can always tell your internet browser that you don’t want to have any cookies downloaded to your computer. Check with the provider of your particular browser to find out how. Before you do however, note that deleting cookies or directing your browser to refuse them may limit your ability to use certain portions of our site that require cookies to function.

Since we are located in the United States, information collected by us will be stored and processed in the United States of America. However, our vendors mentioned below may store and process information that they collect in other countries. By using the Service, you consent to any such transfer of information outside of your country, where data protection laws may be different. We make no representation or warranty with respect to any duty to permanently store any information you may provide.

By using our services and providing us with information, except to the extent prohibited by law, you waive any claims that may arise under your own or any other local or national laws, rules, regulations or international treaties. We may from time to time transfer or merge your information collected offline to our online databases or store offline information in an electronic format. We may also combine information we collect online with information available from other sources, including information received from our partners.

This Privacy Policy applies to your information for as long as your information is in our possession.

To Our European Users

We have the following “lawful bases” for collecting and storing personal information from residents of the European Economic Area.

  • In order to perform our obligations to you, such as providing the Services through the site, like sending you our newsletter and providing you with relevant information.
  • In order to comply with the law.
  • For our legitimate interests, which means we have a good and fair reason to use the data you provide in ways that do not harm your interests and rights. This includes using your data to improve and update the site, maintain the safety and security of the site, and communicate with you regarding our Services.

We will not send you our newsletter unless you opt in to receiving it. You may unsubscribe at any time. Note, though, that we will still send emails to you related to specific transactions that you authorize.

Third Party Vendors

We use the following third party vendors to help us provide, maintain, administer and improve our services.

Information that you submit to these vendors, and the use of that information, is governed by the applicable vendor’s terms and privacy policies, which are linked below.

Protecting Your Information

We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information. However, the internet by its nature is not a secure environment and the nature of security risks is constantly evolving, as are the technical and organizational industry standards relating to management of those risks. While we strive to keep current our security technology and will review, refine and upgrade our security technology as we deem appropriate based on new tools that may become available in the future, the complete security of any information collected, stored or used by us cannot therefore be guaranteed.

In the unlikely event that an unauthorized third party compromises our security measures, to the extent not prohibited by law, we will not be responsible for any damages directly or indirectly caused by an unauthorized third party’s ability to view, use or disseminate such information. If you ever discover inaccuracies in our data, we urge you to notify us immediately.

You hereby acknowledge that we will not be responsible or liable for any dissemination of your information that results from your disclosure of such information to any third party.

Disclosure Policy

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. As discussed above, this does not include trusted third parties who assist us in operating our site, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect our or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

We also reserve the right, and you hereby authorize us, to share or disclose your personally identifiable information, including, without limitation, any content, records or electronic communications of any kind, when we determine, in our sole discretion, that the disclosure of such information is necessary to identify, contact, or bring legal action against you if:

  • you are or may be violating our Terms of Use or this Privacy Policy;
  • you are interfering with our or a third party’s rights or property;
  • you are violating any applicable law, rule or regulation;
  • necessary or required by any applicable law, rule or regulation; or
  • requested by governmental authorities in the event of any investigation, act of terrorism or instance of local, regional or national emergency.

If we are, or the Service is, acquired by or merged with a third party entity, or we sell all or substantially all of our assets, we reserve the right, in any of these circumstances, to transfer or assign the information and content we have received and collected from our users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personally identifiable information is treated, transferred, or used.

Third Party Links

Occasionally, at our discretion, we may include or offer third party products or services on our site. These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

Your Rights Concerning Your Information

You always have the option not to provide information by choosing not to use the service or by not using the particular feature of the service for which the information is being collected. We will provide you with reasonable access to personally identifiable information you provide us for as long as we maintain that information in a readily accessible format. We will also work with you to correct any error in your personally identifiable information. If you wish to access or correct any personally identifiable information that you have submitted through the Service, or to have us completely remove your personally identifiable information from our systems, please send an e-mail with your specific request to operator@publicannouncement.org.
